Kewl Wind LLC — Virtual Currency (KP / Kewl Potions - Astro Coins), No-Refund Policy & Google Play IAP Compliance

 

Effective Upon Access and Use

Kewl Wind LLC (“Kewl Wind,” “we,” “our,” or “us”) utilizes a proprietary virtual currency system known as KP – Kewl Potions. KP is used exclusively within Kewl Wind LLC–published mobile games and is implemented across all current and future mobile gaming titles released by Kewl Wind LLC.

1. Definition of KP (Kewl Potions)

KP (Kewl Potions) & Astro coins are virtual in-game points that may be earned or purchased by users through authorized platforms, including Google Play, Google Pay, and Google Play In-App Purchases (IAP). KP does not contains real-world monetary value; only in game-value; is non-transferable, non-exchangeable, non-consumable/consumable, and may only be used within Kewl Wind LLC mobile games as expressly permitted by each game’s mechanics and rules.​

2. Exclusive In-Game Usage

KP & Astro coins non-consumable/consumable are strictly limited to in-game use and may only be utilized within Kewl Wind LLC mobile games for purposes including, but not limited to:

• Unlocking in-game content, increasing digital value, advancing your features, or levels, and/ or PROPS, game play entries.

KP & Astro coins cannot be redeemed for real-world currency, cannot be transferred, and cannot be used outside of Kewl Wind LLC mobile games under any circumstances.

3. No-Refund Policy (Subject to Platform Law & Policy)

All purchases of KP (Kewl Potions) & Astro coins are intended to be final and non-refundable. Users expressly acknowledge and agree that no refunds, exchanges, or reversals will be issued by Kewl Wind LLC except where required by applicable law or mandated by Google Play’s refund policies.

Users understand and agree that:

• Accidental or unintended purchases do not guarantee a refund

• Loss of KP & Astro coins due to gameplay, account actions, device changes, or account termination does not entitle the user to reimbursement

• Any refund eligibility is governed solely by Google Play’s refund policy, including time-based limitations (such as the 48-hour refund window where applicable)

4. Google Play In-App Purchase (IAP) Compliance

Google Play allows users to purchase in-game points (virtual currency) within a Google Play game using 

Google Play's In-App Purchase (IAP) system, allowing the use of real money or converted Google Play Credit for digital items like game currency, with developers integrating the purchase flow through Google Play Billing Library. You can also often convert earned Google Play Points into these in-game items or store credit to use for purchases. 

Kewl Wind LLC fully complies with all Google Play In-App Purchase (IAP) policies and guidelines, including but not limited to the following principles:

Transparency & Accuracy
All prices, purchase terms, and item descriptions for KP Astro coins and related in-game items are clearly displayed and accurately match the corresponding Google Play Store listings.

Digital Goods Only
Google Play Billing is used exclusively for digital goods, in-game content, functionality, and subscriptions. Kewl Wind LLC does not use Google Play Billing for physical goods or real-world services.

Catalog Management
Kewl Wind LLC adheres to Google Play’s catalog structure requirements, including limits on subscription base plans and offers, and utilizes appropriate tagging and organization to ensure clarity and compliance.

Product Details
All purchasable items include clear names, accurate descriptions, and unique visual identifiers, ensuring users understand what they are purchasing prior to completing a transaction.

Subscriptions
Where applicable, subscriptions are managed in accordance with Google Play policies, including the use of base plans, offers, and eligibility criteria for personalized or promotional pricing.

Refund Handling
While Kewl Wind LLC maintains a strict no-refund intent, all refunds—where required—are processed in full compliance with Google Play’s refund policies, including eligibility windows and platform-mandated procedures.

5. Legal Compliance

The implementation, sale, and use of KP (Kewl Points) & Astro coins are conducted in full compliance with:

• Applicable local, state, federal, and international laws

• Google Play Developer Program Policies

• Google Play Billing and In-App Purchase requirements

KP is a virtual in-game currency and does not constitute real currency, stored value, or a financial instrument.

6. User Agreement & Binding Acceptance

By accessing, browsing, downloading, installing, or using:

• Any website operated by Kewl Wind LLC

• Any mobile game published by Kewl Wind LLC

Users fully, knowingly, and irrevocably agree to:

• The exclusive in-game nature of KP & Astro coins.

• The stated no-refund policy (subject to applicable law and Google Play requirements)

• All terms, limitations, and legal conditions described herein

Continued use of Kewl Wind LLC’s website and mobile games constitutes complete and binding acceptance of this policy. Users who do not agree must immediately discontinue use of all Kewl Wind LLC products and services.

7. Modifications & Continuity

Kewl Wind LLC reserves the right to modify, update, or discontinue KP or this policy at any time in accordance with applicable law and Google Play requirements. Continued use following any changes constitutes acceptance of the revised terms.
